By accessing or using Explain My Bill ("the Service"), operated by Pure Harmony LLC ("we," "us," or "our"), located at 30 N Gould St Ste N, Sheridan, WY 82801, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Eligibility and Age Requirement

You must meet the following requirements to use the Service:

• You must be at least 18 years of age to create an account and use the Service
• You must have the legal capacity to enter into a binding agreement
• You must not be prohibited from using the Service under applicable laws
• If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms

By creating an account, you represent and warrant that you meet all eligibility requirements. We reserve the right to request verification of age and to terminate accounts that do not meet these requirements.

3. Description of Service

Explain My Bill is an AI-powered document analysis platform that helps users understand bills, subscriptions, contracts, and other financial documents. The Service is available as a web application and as a Progressive Web App (PWA) for mobile devices. The Service provides:

• Automated text extraction from uploaded documents using OCR technology
• AI-powered analysis of document content using GPT-4
• Identification of costs, fees, and potential savings opportunities
• Detection of hidden charges and overcharges
• Recommendations and actionable insights
• Market price comparisons and negotiation templates (premium features)

4. User Accounts and Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

5. Subscription Plans and Payments

We offer the following subscription tiers:

By subscribing to a paid plan:

• You authorize us to charge your payment method for the subscription fee
• Subscriptions automatically renew unless canceled before the renewal date
• Prices are subject to change with 30 days' notice to existing subscribers
• You can cancel your subscription at any time from your account dashboard
• Upon cancellation, you retain access until the end of the current billing period

All payments are processed securely through Stripe, Inc. (PCI DSS Level 1 certified). We do not store your credit card information on our servers.

6. Refund Policy

6.1 Subscription Refunds

We offer a 30-day money-back guarantee on your first subscription payment. If you are not satisfied with the Service within the first 30 days, contact us at [email protected] for a full refund.

6.2 Renewal Refunds

For automatic renewal charges, you may request a refund within 7 days of the renewal date if you did not intend to renew. After 7 days, renewal charges are non-refundable.

6.3 Pro-Rated Refunds

If you downgrade your plan mid-cycle, the unused portion will be credited toward your next billing period. No cash refunds are provided for mid-cycle downgrades.

6.4 How to Request a Refund

7. Mobile Application Terms

The Service is available as a Progressive Web App (PWA) that can be installed on mobile devices. The following additional terms apply:

7.1 App Distribution

The app may be distributed through the Apple App Store, Google Play Store, or directly via the web. App store-specific terms and conditions also apply when downloading from those platforms.

7.2 Device Permissions

The app may request access to your device's camera (for document scanning) and file storage (for document upload). These permissions are optional and only activated when you explicitly initiate the relevant feature. The app does not access any device features in the background.

7.3 Offline Functionality

Limited offline functionality is available through the PWA. Document analysis requires an active internet connection. Cached data may be stored locally on your device for performance purposes.

7.4 App Store Acknowledgments

You acknowledge that: (a) these Terms are between you and Pure Harmony LLC, not with Apple Inc. or Google LLC; (b) Pure Harmony LLC, not the app store, is solely responsible for the app and its content; (c) the app store has no obligation to provide maintenance or support for the app; and (d) in the event of any failure of the app to conform to applicable warranties, you may notify the app store for a refund, and the app store shall have no other warranty obligation.

8. Acceptable Use Policy

You agree not to use the Service to:

• Upload documents containing illegal content or violating third-party rights
• Attempt to reverse engineer, decompile, or extract the source code
• Use automated systems (bots, scrapers) to access the Service
• Interfere with or disrupt the Service or servers
• Impersonate any person or entity
• Upload malware, viruses, or malicious code
• Violate any applicable laws or regulations
• Resell or redistribute the Service without authorization
• Attempt to circumvent usage limits or subscription restrictions

9. Intellectual Property Rights

The Service, including its software, design, text, graphics, logos, and other content, is owned by Pure Harmony LLC and protected by copyright, trademark, and other intellectual property laws. You retain ownership of documents you upload, but grant us a limited, non-exclusive license to process them solely for providing the Service. This license terminates when your documents are deleted.

You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Accuracy, completeness, or reliability of analysis results
• Fitness for a particular purpose or merchantability
• Uninterrupted or error-free operation
• Security of data transmission or storage

THE SERVICE IS FOR INFORMATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE LEGAL, FINANCIAL, OR PROFESSIONAL ADVICE. Always consult qualified professionals for important financial or legal decisions.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PURE HARMONY LLC SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Errors or inaccuracies in analysis results
• Unauthorized access to or alteration of your data
• Actions taken based on information provided by the Service

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless Pure Harmony LLC, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you upload to the Service.

13. Data Privacy and Security

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information and uploaded documents. By using the Service, you consent to our data practices as described in the Privacy Policy.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service immediately ceases, and we may delete your account and data after a 30-day grace period. Provisions that by their nature should survive termination (including intellectual property rights, disclaimers, indemnification, and limitations of liability) shall continue to apply.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through:

1. Good faith negotiations between the parties for a period of at least 30 days
2. Binding arbitration under the rules of the American Arbitration Association if negotiations fail
3. Arbitration shall take place in Sheridan County, Wyoming, and judgment may be entered in any court of competent jurisdiction

You waive any right to participate in class action lawsuits or class-wide arbitration.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Pure Harmony LLC regarding the use of the Service and supersede all prior agreements, understandings, and communications, whether written or oral.

18. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email at least 14 days before they take effect and post a prominent notice on the Service. Your continued use after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service and cancel your account.
